TERMS OF USE AND CONDITIONS OF PURCHASE

Welcome to curdbox and our cheesy Terms of Use and Conditions of Purchase (aka “the terms”) —please read them carefully, the future of the universe is at stake! 

By subscribing to curdbox, you agree to these terms. If you do not agree to these terms, you are not entitled to a curdbox subscription—this goes for whether you’re buying for yourself or for someone else, them’s the facts.

We can change these Terms at any time, but we’ll let you know when we do. By continuing to use curdbox, you accept the revised terms. You are free to reject the terms, but in that case you can’t continue your curdbox subscription and that would be sad for everyone.

1. Privacy Policy

Please read our privacy policy, available on our Privacy Policy page, for information about how we collect, use and disclose information about you.

2. Eligibility

In order to sign up for a curdbox, you have to have not been previously suspended or removed from our platform—that makes sense, right? 

3. Registration, Account and Communication Preferences

In order to manage your subscription, you need to register for a curdbox account. You will get a link to set up this account when you subscribe–but you can always email us at crew@curdbox.com and we can resend that invite. If you tried to manage your account and it says you don’t have an account, don’t panic (a lot of people panic!) it just means you still need to set it up! By creating this account, you agree that the information you provide is accurate and up-to-date. This means, you should double check the address of your Great Aunt Sue before you send her a box. We can be responsible when we send a lovely box of cheese to the wrong address you gave us.  You are responsible for all activity under your account, but if you think your account may have been compromised, please let us know ASAP!

By signing up for a curdbox account, you also agree to receive electronic communications from us—these will be a mix of emails about your account, and marketing emails. You can unsubscribe from the marketing emails at any time, but we’ll still need to email you about your account and orders, which includes emails about subscription renewals, order confirmations, shipping reminders, and tracking info.

4. Terms of Sale

4.1 Subscription

  • (a) curdbox is a subscription service, with various subscription plans (monthly, prepaid renewing, prepaid gift). We have two main types of subscriptions: gift subscriptions and renewing subscriptions. Gift subscriptions are a one-time charge and do not automatically renew. Renewing subscriptions charge your saved payment method on the selected interval (monthly, or prepaid 3-, 6-, or 12-months), and always on the 24th of whichever month in the payment cycle you’re on.
  • (b) Automatic Renewals: When you purchase a curdbox subscription, you agree that:

    • We (via our third party payment processor) are authorized to charge you the price of you subscription (plus shipping) for as long as your subscription continues.

    • For our renewing (i.e. non-gift) subscriptions, your subscription is continuous until you cancel it or we suspend or cancel it.

  • (c) Cancellation policy: You can cancel your subscription at any time prior to the next order date (which is always the 24th of the month for curdbox) by logging into your account and cancelling your subscription, or by emailing crew@curdbox.com. IMPORTANT NOTE: Cancelling your subscription stops further charges to your account, but it does not cancel or refund any existing orders (i.e. orders/charges that have already gone through). You are responsible for all charges prior to the cancellation. If you cancel a prepaid subscription, you will continue to receive the remaining boxes you have paid for.

4.2 Gifts

When you purchase a gift subscription you will be charged at the time of purchase and it will not renew at the end of the 3, 6, or 12 months that you purchased. Every month during the length of the gift you will see the order process for $0. If you choose to give (or accidentally choose to give–it happens!) a recurring subscription as a gift instead of a gift subscription option, you will be responsible for cancelling the subscription. You are responsible for carefully making the correct purchase choice for your situation. We believe in you.

If you purchase a gift subscription for someone else, you are responsible for alerting them to its delivery (arrival dates listed on the Shipping Info page). We do not offer refunds or replacements for boxes that were not retrieved on time because the recipient was unaware that it is coming.

4.3 Payment and Billing Information

You should only supply a payment method that you are authorized to use, and it should be kept current and up-to-date. By entering a payment method at checkout, you authorize us to charge it for the full amount of the order.

You are responsible for, and agree to pay, all charges for your selected subscription plan. If there’s a payment failure, we will notify you and try to charge you again for three more days. If the charge still doesn’t go through, your subscription will be suspended until you provide a valid payment method. You can change or update your payment method by logging into your account and editing your payment information.

4.4 Pricing and Availability

All of our prices are in U.S. dollars. If we ever have to change the price of curdbox or shipping, we’ll let you know! If we warn you of a price change and you don’t change your subscription, then that will mean you accept the change. 

4.5 Taxes

If you live in a state that collects tax on certain items, we will add that tax onto your order. 

4.6 Shipping and Handling

Your order total will be the price of a curdbox with free shipping (multiplied by the number of months prepaid, if it’s a prepaid subscription).  If our shipping costs change, we’ll let you know ahead of time.

Our original curdboxes always ship on the Tuesday that’s the day before the third Wednesday of the month (confusingly this is not always the third Tuesday of the month!)  While we have 1-2 day shipping, the actual delivery date may vary. Expected arrival dates are listed on Shipping Info page.

4.7 Deliveries

Our courier (FedEx) will leave your package at your house (or with someone if you have an apartment concierge.) Because of porch theft, sometimes they’ll leave the box slightly hidden or out of the way—make sure you look thoroughly if you think it wasn’t delivered! You are responsible for retrieving your box on the same day of its arrival, and we are not liable for replacements if a box was left out overnight, causing the cheese to warm.

We are unable to deliver to PO boxes. If you list a PO box for your shipping address and your box is not delivered, you are not entitled for a refund. 

Our cheeses are individually wrapped and labeled and are then placed inside our boxes with insulation and ice packs so that the cheese is kept cold during shipment. When your box arrives, the ice packs may have already melted (this is in the warmer months expected), but this is ok! As long as the cheeses are still cool to the touch, they’re good. That being said, you should immediately refrigerate all perishable items as soon as possible after delivery, and you should always inspect your delivery to confirm that the ingredients arrive in a cooler than room temperature condition. It’s your responsibility to inspect all products you receive from us for any damage or other issues upon delivery, and you are solely responsible for determining the freshness of the products you receive. If you are worried that any cheese or pairing that you’ve received isn’t safe to eat, contact us at crew@curdbox.com within 24 hours of delivery with a description of your concern, and photos of the items—do not discard the items until contacting us! Please do keep in mind that mold on cheese isn’t necessarily a cause for concern, indeed some cheeses are expected to have mold—cheese and mold are best friends!

You consume our products at your own risk, and you are solely responsible for the proper and safe handling, storage, use and consumption after they have been delivered. Failure to follow safe food handling practices and temperature recommendations may increase the risk of foodborne illness. We recommend consuming perishable items within a week for optimal taste, texture and safety. In addition, pregnant women, young children, the elderly and individuals with compromised immune systems should follow the U.S. Food and Drug Administration’s recommendations on food consumption for at-risk groups, which can be found here.

Anyone that is at the delivery address and who accepts a delivery from us is presumed to be authorized to receive such delivery, and anyone that accepts the package at the delivery address accepts our delivery terms under these same conditions. You will have the tracking number, please use it! Your cheese is depending on you.

In the case of inclement weather or other events beyond our control that interfere with our ability to deliver your order, we will attempt to deliver your order as soon as reasonably possible. In the event of a courier delay, please inspect the contents carefully and email crew@curdbox.com immediately with any concerns (attaching photos for review). In the event that timely delivery of your ingredients is not feasible, (usually due to regional weather or shipper alert issues) we will contact you with an update on when to expect your delivery.

4.8       Returns and Refunds

a) Standard Return/Refund Policy

    • (i) Because curdbox contains perishable items which are not able to be restocked or resold, we are not able to accept returns.

    • (ii) If you are not satisfied with the condition of your curdbox, please contact crew@curdbox.com within 24 hours of receiving your box with a description and photos of the issue. We will happily review you your order and any reported issues and offer an appropriate resolution, which may include replacement of the product in question, credit towards your next box, or a partial/full refund.

    • (iii) We can only guarantee delivery to the address provided when the order is placed. Our subscriptions renew on the 24th of the month, so make sure to log into your account before then to make any delivery address changes for the next box. You can email us at crew@curdbox.com soon after you place an order, or after an order automatically processes as part of your subscription, to change the shipping address and we may be able to do so, depending on the timing of the request, but cannot guarantee it. After an item is shipped, we are not able to reroute it to a new address.

    • (iv) Due to the perishable nature of our product, we cannot guarantee the condition of the curdbox if you are unable to receive your curdbox when it’s delivered. All of our expected delivery dates are listed on Shipping Info page and it is your sole responsibility to ensure the address is correct and that you can retrieve the box when it arrives. We send out a reminder the Saturday before the curdbox ships that it will be shipping Tuesday. You will get an email on “shipping” Tuesday evening or first thing Wednesday with the tracking number.

    • (v) When placing your order, please enter your shipping address carefully to ensure accuracy and your order confirmation email for any errors. The order confirmation email will list both the shipping and billing addresses, and it is your responsibility to make sure these are entered correctly. If you enter the shipping address incorrectly when the order is placed, please email us at crew@curdbox.com immediately with the correct address. If you log into your account and change the address there, that will only change it for future orders but will not change it for the most recent order. If you want to change your shipping address before the next order is processed (on the 24th of the month for curdbox), you can log into your account and change it there, or email us at to crew@curdbox.com with the change. If you ordered a prepaid renewing subscription or a gift subscription you will not be able to change the address yourself. Please email the happy people at crew@curdbox.com and they will make that change for you. You will be charged or refunded if the address is in a different shipping zone.

    • (vi) If your order is returned to us because you provided an incorrect address or because the box was refused when shipped according to our terms and conditions, then we must dispose of the contents and you will not be refunded. In the event an order is delivered late due to an incorrect address or if you are unable to retrieve on the delivery date without prior notification and spoilage/damage occurs, you will not be refunded. If you would like an order that was improperly addressed or not retrieved on the guaranteed delivery date reshipped, you will be charged $50 for the replacement shipment for curdbox.

    • (vii) If you purchased a gift subscription for someone else, you are responsible for alerting them to its delivery (arrival dates listed on the Shipping Info page). We do not offer refunds or replacements for boxes that were not retrieved on time because the recipient was unaware that it is coming.

(b) Return/Refund Policy for Cancelled Orders. You are liable for any orders placed or charges to your account before your cancellation request. This means that if you cancel your subscription after an order goes through, this will cancel future orders but will NOT cancel and refund the most recent order. We are not obligated to offer refunds or to cancel orders after the orders have processed, either with the initial purchase nor when the subscription renews on the 24th of the month for original curdbox. We send an email three days before your subscription renews in order to give you time to cancel or skip your box before the next order goes through on the 24th of the month for original curdbox..

 

(c) Return/Refund Policy for Damaged Products.

 

  • (i) We strive to provide a great selection of quality products delivered to your door every month and guarantee that your order will arrive in good condition when delivered to the address on file and retrieved on the guaranteed delivery date.
  • (ii) While we would love every delivery to arrive on time and without issue, delays or damage can occur once the package is in transit via the courier (FedEx) that are out of our control due to weather, accidents, etc. In the event of damage caused by improper handling or late delivery, we are happy to file a claim, and we may either replace the shipment, replace specific items that were damaged, offer you a credit towards your next box, or offer a partial or full refund. We ask that you please email crew@curdbox.com within 24 hours of receipt, provide a description of the damage, and a photo(s) of the order in the state it was received. Claim filing is time sensitive and photos are required in order to show proof of damage.

(d) Return/Refund Policy for Other Reasons.

  • (i) Because curdbox is a subscription that is premised on discovering new products, no full or partial refund will be given if the customer simply does not like products they received. By purchasing curdbox, the customer understands that they may not personally like all products and agrees to pay for all products regardless if they like them or not.
  • (ii) Because we are not able to accommodate allergies, no full or partial refund will be given if a customer cannot eat products due to an allergy to one or several of the products. By purchasing curdbox, the customer understands they are responsible for paying for all products even if they can't one or several due to an allergy.
  • (iii) If a box has been delivered but then is stolen before the customer can retrieve it, curdbox is not liable and will not offer a free replacement. Customers can buy a replacement box for $50. The customer should also file a police report about the theft.

 


5. License to Access and Use Our Sites and Content

Unless otherwise indicated in writing by us, our content is protected by U.S. and international copyright law. This means you cannot download or use any part of our website or logo, nor any of our designs, content, or data without our express permission for any purpose, whether it be commercial or otherwise. Our site does use software from third parties, which have separate licenses, and so those license terms govern their respective components.

6. Trademarks

curdbox,” the curdbox logo, and any content that appears on our site are trademarks of curdbox and cannot be used for any purpose without our written permission, including in metatags or hidden tags. The logos and product names we mention on our site are trademarked by those companies and also cannot be taken from our site.

7. Hyperlinks

curdbox makes no claim or representation regarding, and accepts no responsibility for, the quality, content, nature or reliability of third party websites accessible by hyperlink from our site. Such sites are not under our control, and we are not responsible for the contents of any linked site, any link contained in a linked site, or any review, changes or updates to such sites. We provide these links to you only as a convenience, and the inclusion of any link does not imply our affiliation, endorsement or adoption of any site or any information contained therein. When you leave our site, you should be aware that our terms and policies no longer govern.

8. Third Party Content

We may display Third Party Content, such as website content, advertisements and promotions from third parties through our services, including in shipments with our product. We do not control, endorse or adopt any Third Party Content, and we make no representations or warranties of any kind regarding such Third Party Content, including, without limitation, regarding its accuracy or completeness. You acknowledge and agree that your interactions with third parties providing Third Party Content are solely between you and such third parties, and that curdbox is not responsible or liable in any manner for such interactions or Third Party Content.

9. User Conduct

You agree that you will not violate any law, contract, intellectual property or other third party right or commit a tort, and that you are solely responsible for your conduct, while accessing or using our site and service.

By accepting these terms and conditions, you agree that you will not:

  • harass, threaten, intimidate, or otherwise act in a menacing manager towards curdbox employees or other curdbox subscribers (Cheese people are really nice people!);
  • Use or attempt to use another user’s account without authorization from that user and from curdbox;
  • Use the site in any manner that could interfere with other users’ positive experience with the site;
  • Reverse-engineer our site or service, nor do anything that might discover source code or try to access content or parts of the site that are not made public;
  • Attempt to access any feature or area of the site that you are not authorized to access;
  • Develop any third party applications that interact with the site without our prior written consent;
  • Use any tool to extract data from the site or interfere with its function;
  • Use the site for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms.

 10. Feedback

You are always free to submit questions, comments, suggestions, ideas, original or creative materials or other information about curdbox. Any feedback you submit is non-confidential and is the sole property of curdbox, so we can use it (and allow others to use it) without limitation without acknowledgment or compensation to you.

11. Disclaimers

  • You are solely responsible for the proper and safe handling, preparation, storage, cooking, use and consumption of the cheese and pairing you receive from us.
  • You are also solely responsible for knowing about any food allergies you may have and for verifying the suitability of all products and their ingredients before handling, preparing, using or consuming such products.

  • Further, you understand, acknowledge and agree that products are packaged and stored in facilities that may handle foods with allergens (milk, wheat, egg, soy, fish, shellfish, peanuts and treenuts) and we cannot guarantee that cross-contamination will not occur between products. 

12. Limitation of Liability; Release 

curdbox is not responsible for punitive damages of any kind arising from or in any way related to the access or use of our site, content, or services.

Curdbox is liable for at most the cost of the curdbox. So if there is an issue with your order or box, you’ll either get a refund for your order or new product depending on the issue.

13. Governing Law and Venue

These terms, your use of our website, and your subscription to curdbox are governed under the laws of the Commonwealth of Massachusetts.

14. Termination

We have the right to terminate your right to access our site and your account, or to receive curdbox at any time and for any or no reason. You acknowledge and agree that in this case, we have no obligation to you and you are not be entitled to a refund of any amount that you have already paid to us for product that has already been received.

15. Severability

If any term, clause or provision of these Terms is held invalid or unenforceable, then that term, clause or provision will be severable from these Terms and will not affect the validity or enforceability of any remaining part of that term, clause or provision, or any other term, clause or provision of these Terms.

16. Miscellaneous

These Terms constitute the entire agreement between you and curdbox relating to your access to and use of our site and services, and cannot be transferred to anyone else. No waiver of any provision of these Terms will constitute a waiver of such provision in any prior, concurrent or subsequent circumstance, and curdbox’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
